Agency supply is now a board-level control: price, contract and safeguarding have to align
A 3 September guidance update changed the name of the government buying body, not the rules. The material shift is the new supply-staff framework, an approaching academy-trust duty and the safeguarding responsibility that no approved agency can take away.

The buying route is changing; the trust’s responsibility for safe, sustainable staffing is not.
The 3 September edit to DfE’s established supply guidance was administrative. The material operating change is RM6376 and the new handbook requirement governing how academy trusts buy agency supply staff.123
Commercial compliance cannot be separated from workforce continuity or safeguarding. Leaders need one assurance chain joining the requirement, contract, charge, worker, agency confirmation, identity check and single central record.25

The 3 September update changed the label, not the rule
DfE’s update log says references to Crown Commercial Service were changed to Government Commercial Agency and links were updated. GCA had replaced CCS on 1 April 2026, while earlier contract documents remained valid.12
RM6376 covers temporary, fixed-term and permanent teaching, support and non-teaching roles. It provides transparent cost breakdowns, maximum supplier fees and a no-additional-fee temporary-to-permanent route after 12 weeks with four weeks’ notice.2

The requirement has a live commencement-date discrepancy
The 2026 handbook says it is effective from 1 October and paragraph 2.28 requires trusts to use RM6376 unless an alternative agreement is procurement-compliant and has rates no higher than those available through the framework.3
DfE mandate guidance and GCA’s framework page say the mandate applies from September. Existing compliant contracts do not have to be ended early, direct recruitment continues through normal processes and public-body staff pools are outside the stated agency mandate.24
- Aggregate expected agency spend across the trust and contract term.
- Retain the procurement route, rate comparison, approval and review date for any alternative.
- Measure total workforce value rather than treating the lowest mark-up as a complete conclusion.

An approved agency cannot complete the school’s assurance decision
Schools must obtain written confirmation that the agency completed the checks the school would otherwise perform and obtained the appropriate enhanced DBS certificate. Where disclosed information exists, the school must obtain the certificate; required barred-list information must be secured before appointment.5
Agency and third-party staff must appear on the single central record even if they work for one day. The record must show whether confirmation was received, its date and whether enhanced-DBS details were supplied. The school should also verify that the person arriving is the person checked.5

Build one board-visible control from request to deployment
Now, map every agency, contract, expiry, role category and annualised trust-wide cost; compare current terms with RM6376; and reconcile agency confirmations with the single central record before deployment.245
Next, give the accounting officer and board a single assurance view covering compliance, supplier fees, worker pay, fill quality, safeguarding exceptions, temporary-to-permanent dates and the effect of recurring cover on pupils and permanent staff.
